Unfortunately, the work environment was far from friendly. The diner\u2019s owner created a hostile environment for employees and violated their workplace rights.&nbsp;<\/p>\n<p>As servers, they were ordered to share or \u201cpool\u201d their tips together, a practice that is <a href=\"https:\/\/www.dol.gov\/agencies\/whd\/fact-sheets\/15-tipped-employees-flsa\" target=\"_blank\" rel=\"noopener\">illegal under the Fair Labor Standards Act<\/a> (FLSA). If they did not combine their tips, the owner would respond with condescension \u2013 despite their concerns being legitimate. Sometimes the pooling was done to give tips to non-servers on staff, while other times the servers were told they had to cover the restaurant\u2019s credit card fees. <a href=\"https:\/\/www.dol.gov\/newsroom\/releases\/sol\/sol20240822\" target=\"_blank\" rel=\"noopener\">Other employees were denied overtime, or faced employer retaliation for their legitimate grievances<\/a>.&nbsp;<\/p>\n<p>\u201cWe made jokes about us having PTSD from all the stress that owner has put on us,\u201d Kyle said, but this gallows humor was inspired by real physical consequences, and it reached a point where several employees complained about their work environment to their doctors.<\/p>\n<figure role=\"group\" class=\"caption caption-img align-left\">\n<img loading=\"lazy\" decoding=\"async\" alt=\"A woman posing in front of trees and a stream. \" data-entity-type=\"file\" data-entity-uuid=\"dc13a3d0-bc39-4a80-8f35-9e06277c8bf5\" height=\"172\" src=\"http:\/\/blog.dol.gov\/sites\/default\/files\/inline-images\/Annette_featured.png\" width=\"250\" loading=\"lazy\"><figcaption>Annette<\/figcaption><\/figure>\n<p>No worker should face this type of wage theft and retaliation, which is why the Wage and Hour Division stepped in to investigate Friendship Diner. In early 2023, an investigator from the division collected detailed information from current and former workers at the restaurant.&nbsp;<\/p>\n<p>Although the workers felt uneasy about talking to the division \u2013 sometimes out of fear of further <a href=\"https:\/\/www.dol.gov\/agencies\/whd\/retaliation\" target=\"_blank\" rel=\"noopener\">retaliation<\/a> \u2013 the investigator helped put them at ease.&nbsp;<\/p>\n<p>Laura said, \u201cThe work [the investigator] put into the case was fantastic&#8230; I\u2019m really grateful for [the division] helping us and that justice was served.\u201d Laura also encourages workers in a similar situation to reach out, adding, \u201cIf you report something [to the Wage and Hour Division], you are helping your co-workers as well.\u201d<\/p>\n<p>After the investigation concluded, an Indiana court ordered the owner of Friendship Diner to pay $390,000 in wages and damages to 44 employees, including Annette, Kyle and Laura. In addition, the court ordered the owner to display the judgment inside the restaurant.&nbsp;<\/p>\n<figure role=\"group\" class=\"caption caption-img align-right\">\n<img loading=\"lazy\" decoding=\"async\" alt=\"A woman posing in front of a brick wall.\" data-entity-type=\"file\" data-entity-uuid=\"c1557a7e-c131-4737-b06d-f9a8e18c1014\" height=\"171\" src=\"http:\/\/blog.dol.gov\/sites\/default\/files\/inline-images\/Laura_featured.png\" width=\"249\" loading=\"lazy\"><figcaption>Laura<\/figcaption><\/figure>\n<p>Back wages will help these workers with basic living expenses like <a href=\"https:\/\/www.dol.gov\/agencies\/whd\/data\" target=\"_blank\" rel=\"noopener\">food and child care<\/a>. For Laura, the money means she can take her husband to a college football game and pay for her son\u2019s driving classes.&nbsp;<\/p>\n<p>\u201c[The Wage and Hour Division]&nbsp;is there for you and they fight for the underdog,\u201d says Annette.
